Provisions

TITLE 7: CRIMES WITH A VEHICLE

Crimes with a Vehicle are offenses committed with the vehicle.

Crimes with a Vehicle are all crimes with statute codes 001 through 708.

Title 7 is split into a total of 7 Divisions.

DIVISION 0: CLASSIFICATIONS

**__001. License Suspension and Revocation__** *(a)* A person who drives a motor vehicle and receives three (3) warnings on their license shall have their license suspended for forty-eight (48) hours.

*(b)* A person who drives a motor vehicle and receives five (5) warnings on their license shall have their vehicle impounded and their license revoked.

*(c) Warnings on a driver's license fall off every two (2) weeks or are removed upon revocation of the license.

**__002. Officer Discretion__** *(a)* Any peace officer with probable cause to make a vehicle stop or otherwise detain another person under the San Andreas Vehicle Code, as listed below, may use their discretion when issuing an infraction or points on the license of the person operating the vehicle, except when the vehicle operator is acting in an unsafe manner.

DIVISION 1: REGISTRATION OF VEHICLES AND CERTIFICATES OF TITLE

Division 1 includes offenses relating to vehicle registration and certifications, with statute code 101.

DIVISION 2: DRIVERS LICENSE

Division 2 includes offenses relating to one's driver's license or learner's permit, with statute codes 201 through 203.

DIVISION 3: FINANCIAL RESPONSIBILITY LAWS

Division 3 includes offenses relating to all financial regulations of one's motor vehicle, with statute code 301.

DIVISION 4: RULES OF THE ROAD

Division 4 includes offenses relating to regulations and laws governing the usage of all public and private roads within the state of San Andreas, with statute codes 401 through 410.

DIVISION 5: EQUIPMENT OF VEHICLES

Division 5 includes offenses relating to all equipment and modifications done to one's motor vehicle, with statute codes 501 through 503.

DIVISION 6: SAFETY REGULATIONS

Division 6 includes all offenses relating to the safe conduct of motor vehicles and all other safety regulations within the State of San Andreas, with statute codes 601 through 605.

DIVISION 7: COMMERCIAL VEHICLE CODE

Division 7 includes all offenses relating to the safe conduct of commercial vehicles and all other related regulations within the State of San Andreas, with statute codes 701 through 708.

VC 23222 Possession of an Open Container
A person who possesses an visible and open container of alcohol in a public place or in a motor vehicle shall be issued an infraction.

VC 4000 (a) Vehicle Registration Violation
(a) A person who drives, moves, or leaves standing a vehicle on a public road that has not been registered within the State of San Andreas shall be issued an infraction and may have their vehicle impounded at the officer's discretion.

VC 12500 (a) Driving without a Valid License
A person who drives, moves, or otherwise uses a motor vehicle on any public road without being issued a valid driver's license issued by the state, or driving with a license that has been revoked, is guilty of a misdemeanor and vehicle impounded at the officer's discretion.

VC 14601 Driving on a Suspended License
A person who drives, moves, or otherwise uses a vehicle on any public road with a suspended, but otherwise valid, driver's license issued by the state is guilty of misdemeanor.

VC 16028 Driving without Insurance
A person who drives, moves, or otherwise uses a vehicle on any public road without valid motor insurance shall be issued an infraction and may have their vehicle impounded at the officer's discretion.

VC 22350 (a) Speeding
Any person operating a motor vehicle, on any road, 5-10 MPH over the posted speed limit shall be issued an infraction.

VC 21804 Failure to Yield
Any person operating a motor vehicle who does not yield or give right-of-way to another driver in or at an intersection shall be issued an infraction.

VC 21806 Failure to Yield to Emergency Vehicles
Any person operating a motor vehicle who does not yield the right-of-way and immediately drive to the right-hand side of the road, outside of an intersection, to any emergency vehicle which is sounding a siren and has red or blue lights visible shall be issued an infraction.

VC 21461 Failure to Abide by a Traffic Control Device
Any person operating a motor vehicle who disobeys any sign, signal, or other traffic control device including stop signs, traffic lights, pedestrian crosswalks indicated by solid white lines at an intersection, and the direction of a peace officer or construction worker shall be issued an infraction.

VC 22500 Illegal Parking
Any person who stops, parks, or leaves standing any vehicle whether attended or unattended in another of the following places shall be issued an infraction of $950: Obstructing an intersection, alleyway, crosswalk, or public road preventing the flow of traffic. In any manner that obstructs more than two thirds of a sidewalk or pedestrian path. Facing opposite traffic. On any median. In a tunnel. Next to or obstructing any fire hydrant. Within a fire lane, indicated by red painted curbs. On railroad tracks or within range of being struck by a railroad car. In the immediate ambulatory parking or bay area of a hospital or clinic. In front of or obstructing a private driveway or an entrance or exit to a private road or path. A vehicle parked in a manner not permitted by the property owner. Private property may set its own parking rules, so long as they do not obstruct any public roads or sidewalks. Policies may also be set by a property manager authorized by the property owner. State agencies may set parking rules for the facilities they maintain.

VC 27007 Vehicular Noise Violation
Any person whose vehicle emits excessive noise, creating a public nuisance, shall be issued an infraction. Examples include modifications to increase the noise pollution of their vehicle, or the excessive use of a vehicle horn or siren without justifiable purpose.

VC 24008 Illegal Use of Hydraulics
Any person operating a motor vehicle on any public road who uses hydraulic equipment while in motion shall be issued an infraction.

VC 21200 Unsafe Usage of a Bicycle
A person who uses a bicycle or other self-propelled vehicle in a manner that obstructs traffic, incites disorder, creates a hazard, or demonstrates the potential for harm shall be issued an infraction.

VC 21955 Jaywalking
Any person who walks between adjacent intersections controlled by traffic control signal devices or by peace officers at any place in the roadway except in a crosswalk shall be issued an infraction.

VC 23109 Speed Contests
A person who engages in a motor vehicle speed contest on any public road is guilty of a misdemeanor. As used in this section, a motor vehicle speed contest includes a motor vehicle race against another vehicle, a clock, or other timing device.

VC 26708 Tinted Windows
Any person who drives a motor vehicle with any obstructive material placed, displayed, installed, affixed, or applied upon the windshield or side or rear windows shall be issued an infraction.

VC 24250 Driving Without the use of Headlights
A person operation a motor vehicle during darkness, defined as when street lamps are activated (between sunset and sunrise) or in adverse weather conditions with low visibility (e.g. rain, fog, snow), without using headlights shall be issued an infraction.

VC 24002 Operating an Unsafe Vehicle
Any person driving a motor vehicle with any of the following on any public road shall be issued an infraction: (a) Flat or missing tire. (b) One or both taillights damaged or unlit. (c) Missing any door, hood, or trunk lid. (d) Driving with any door, hood, or trunk in an open position.

VC 27803 Failure to Wear a Helmet
A driver and any passenger who operates or rides on a motorcycle or motorized bicycle without a safety helmet shall be issued an infraction.

VC 21712 Unlawful Riding and Towing
Any person operating any vehicle capable of towing or carrying a vehicle who fails to operate their vehicle in a safe manner such as but not limited to speeding with a load, failing to yield where required, allowing a passenger to ride on the trailer or in the vehicle being towed or carried, or if the vehicle or operation is otherwise unsafe on the road, shall be issued an infraction.

VC 23103 Reckless Operation of Machinery
Any person who operates any machinery on any public road shall be issued an infraction. This provision does not apply to individuals operating such vehicles under emergency use by law enforcement or fire response personnel during urgent situations.

VC 38316 Reckless operation off an off-road vehicle
Any person who operates any off-road vehicle on any public road, shall be issued an infraction. This provision does not apply to individuals operating such vehicles under emergency use by law enforcement or fire response personnel during urgent situations.

VC 21712(a) Unlawful Riding in a Vehicle
Any person found in violation of the following shall be issued an infraction: (a) A person driving a motor vehicle who knowingly permits a person to ride on a vehicle or portion of a vehicle that is not designated or intended for the use of passengers (b) A person riding in a vehicle or upon a portion of a vehicle that is not designated or intended for the use of passengers (c) A person driving a motor vehicle who knowingly permits a person to ride in the trunk of that motor vehicle. (d) A person who rides in the trunk of a motor vehicle.

VC 15242 Transport of Commercial Cargo Outside of CDL Certification
A person who transports cargo that does not apply to their CDL shall receive an infraction.

VC 35551 Overweight Load in a Commercial Vehicle
A person whose commercial vehicle outweighs what the vehicle can reasonably and safely carry shall receive an infraction of $25,000.

VC 21702 Drive Time Violation of a Commercial Vehicle
A person who exceeds a driving time of 8 hours or more, including rest stops, without adequate sleep between journeys shall receive an infraction.

VC 32000 (a) Failure to Announce Hazardous Material in a Commercial Vehicle
A person who does not announce hazardous cargo material in their commercial vehicle when interacting with a peace officer, City of Los Santos agent, or at any weighing station shall receive an infraction.

VC 2813 Failure to Surrender Commercial Vehicle to a Weight Station
(a) A person who, while operating a commercial vehicle, fails to adhere to instructions to go to a weigh station by an officer of the Los Santos County Sheriff's Department, or an officer of the Los Santos Police Department, or an officer of the San Andreas Highway Patrol is guilty of a misdemeanor.

Operating a motor vehicle while under the influence of alcohol or drugs, or with a blood alcohol concentration of 0.08 percent or higher.

Leaving the scene of a collision involving damage to property without identifying yourself to the owner.

VC 2800.1 Evading a Peace Officer
Wilfully fleeing or attempting to elude a pursuing peace officer whose vehicle is displaying lights and siren.

Evading a peace officer while driving with wilful or wanton disregard for the safety of persons or property.

VC 4000 (b) Vehicle Registration Violation
A person who drives a motor vehicle without a valid license plate on display while on a public roadway shall be issued an infraction and may have their vehicle impounded at the officer's discretion.

A person who drives a motor vehicle on a public roadway with registration that is expired shall be issued an infraction and may have their vehicle impounded at the officer's discretion.

A person who drives, moves, or otherwise uses a vehicle on any public road without being in physical possession of their driver's license issued by the state shall be issued an infraction.

A person who drives, moves, or otherwise uses a vehicle on any public road with an expired license shall be issued an infraction.

VC 12500 (d) Driving without a Valid License
A person who transports commercial grade goods or operates a commercial grade vehicle without a CDL issued by the state is guilty of a misdemeanor.

Any person operating a motor vehicle, on any road, 11-20 MPH over the posted speed limit shall be issued an infraction.

Failure to Announce Hazardous Material in a Commercial Vehicle
A person who drives a commercial vehicle containing hazardous materials through residential areas shall receive an infraction.

VC 22350 (c) Speeding
Any person operating a motor vehicle, on any road, 21-25 MPH over the posted speed limit shall be issued an infraction.

VC 22350 (d) Super Speeding
Any person operating a motor vehicle, on any road, 26+ MPH over the posted speed limit is guilty of a felony.

VC 48213 (a) Reckless Driving
A person who drives a vehicle upon a public road or highway in willful or wanton disregard for the safety of persons or property is guilty of a misdemeanor.

VC 48213 (b) Reckless Driving
A person who drives a vehicle upon a public road or highway in willful or wanton disregard for the safety of persons or property, and in doing so creates a substantial risk of serious bodily injury, nearly strikes pedestrians or motorists, drives into pedestrian areas, operates in the opposing lane of travel, or otherwise uses the vehicle in a manner that is likely to cause severe harm, is guilty of a felony.
